Juridification of sexuality, biopolitics and law. Foucault before the Commission for the Reform of the Penal Code

Abstract

In the mid-1970s, Foucault spoke before a commission for the reform of the penal code. In this speech, he referred to the phenomenon of the juridification of private sexuality. In this paper, we will briefly examine the context of this speech and Foucault’s political commitment. We will then elucidate what juridification consists of, focusing, first, on how the mechanisms of social normalisation (moralisation and medicalisation) are hybridised with the law through codes and, second, on whether the law, or a certain notion of law, can remain outside juridification as a lever for the struggle for sexual rights.
