Marcelo Raffin es Doctor en Filosofía por la Universidad de París VIII y HDR (Habilitation à diriger des recherches). Investigador Independiente del CONICET en el Instituto de Investigaciones Gino Germani y Profesor Titular Plenario Regular de Filosofía en la Facultad de Ciencias Sociales, UBA, universidad donde también ha sido Profesor Adjunto Regular de Derechos Humanos y Garantías y de Teoría General y Filosofía del Derecho y donde dirige el Programa de Estudios Foucaultianos (PEF). Se ha desempeñado, asimismo, como diplomático de carrera en derechos humanos y cuestiones culturales. Ha publicado, entre otros libros, Verdad y subjetividad en Michel Foucault (1970-1980) (dir., 2019), Pensar con Foucault hoy. Relecturas de Las palabras y las cosas y La voluntad de saber (comp. junto con López, C. y Colombo, A., 2019), Droits de l’homme, sujet et devenir. L’expérience contemporaine du Cône sud d’Amérique latine (2017) y La noción de política en Agamben, Esposito y Negri (ed., 2015). Sus últimas investigaciones se centran en los problemas de la política y la subjetividad, en particular, a partir de Foucault, Agamben y Arendt. Se especializa, asimismo, en cuestiones de derechos humanos.
In this article, I intend to analyze the critical distinction held by Michel Foucault between «rights of Man/human rights» («droits de l’homme”») and «rights of the governed» («droits des gouvernés»). The philosopher argues that the first notion is dependent on governmentality (gouvernementalité) whereas the second one is the affirmation or the assertion of the independence of the governed from it so that both notions imply two heterogeneous conceptions of freedom. More specifically, I will try to develop this distinction between both notions following the Foucauldian position concerning politics and the production of rights, strongly marked in his thought, by the notion of «new right» («nouveau droit»), as a strategy of resistance and as a «practice of freedom». Likewise, the analysis developed aims at examining the potentiality and the scope of human rights in the present political arena from a Foucauldian perspective.
